Duterte’s threats against the ICC will not stop the investigation or process; ultimately deprive victims of justice

Former President Rodrigo Roa Duterte’ graphic and serious threats against the International Criminal Court and personnel will not stop the International Criminal Court (ICC) from pursuing an investigation, possibly issuing a warrant of arrest and taking custody, and eventually proceeding to trial.

It is apparent that his statements undermine the Court’s independence, integrity and impartiality, and some constitute threats of retaliation against the Court and its officials in the event the Court exercises its judicial functions as mandated in the Rome Statute.

His statements only reinforce the reasonable belief that he is most responsible for crimes against humanity committed in the Philippines in the context of the “war on drugs”. And that in effect, he intends to deprive victims of their chance at accountability for thousands of killings. His statements have been brought to the Court’s attention for their appropriate and prompt action. Article 70 of the Rome Statute, the ICC’s founding treaty, punishes offences against the administration of justice, punishable by imprisonment not exceeding five years, or a fine. If he continues with this attitude as the case progresses, he could also be charged separately for this crime before the ICC.
