NUPL demands justice for Davao prosecutor Eleanor Dela Peña
"[W]e refuse to live in fear and demand that our safety and security be ensured, knowing that the independent exercise of our profession is crucial for maintaining the rule of law and upholding justice."

The National Union of Peoples’ Lawyers is a nationwide voluntary association of human rights lawyers in the Philippines, committed to the defense, protection, and promotion of human rights, especially of the poor and the oppressed.

The National Union of Peoples’ Lawyers strongly condemns the killing of Prosecutor Eleanor “Ning” Dela Peña on the afternoon of June 10, 2024. According to reports, she was driving home around 5:00 pm in Digos City, Davao del Sur, when a lone motorcycle-riding gunman shot her to death.

Dela Peña’s murder brings the number of lawyer killings under the Bongbong Marcos administration to four. Since July 2022, the NUPL has recorded 43 incidents of attacks on lawyers, including six attempted killings.

Colleagues from Davao hailed Dela Peña as a dedicated public servant and a loving mother to her four children. She was the Assistant Provincial Prosecutor of Davao Occidental and the former President of IBP-Davao City.

The killings of lawyers have created an atmosphere of fear and intimidation among members of the bar. When perpetrators are not held accountable, the threat of violence discourages lawyers from taking on certain professional duties and hinders their ability to carry out their responsibilities effectively.

We are outraged that the question, “When will these attacks on members of the legal profession end?” remains merely rhetorical. But we refuse to live in fear and demand that our safety and security be ensured, knowing that the independent exercise of our profession is crucial for maintaining the rule of law and upholding justice.

We call on authorities to swiftly and thoroughly investigate and prosecute the perpetrators of Prosecutor Dela Peña’s dastardly murder.#

NUPL urged the Supreme Court to consider safeguards that protect lawyers and litigants and keep court processes safe, including convening a dialogue on effective protective mechanisms, issuing guidance when red-tagging and guilt-by-association narratives surface in court proceedings, and adopting clear protocols for responding to credible threats against counsel.

EDSA at 40: The People’s Forum

The enduring significance of EDSA rests on a simple truth: public spaces belong to the people. They must remain open as platforms for public discourse—robust, uninhibited, and free from the chilling effect of threats of dispersal or prosecution under a statute born of martial rule. EDSA stands as the people’s forum when they demand accountability and seek the fulfillment of the promise of People Power.

PROSECUTION IS TRIAL-READY, ICC SHOULD CONFIRM CHARGES AGAINST DUTERTE

The hearings this week and the eventual trial are important for all Filipinos, as a way of composing a true and correct collective memory, and preserving a historical record of what should not be repeated again. The confirmation hearing is so important that victims and their lawyers, supporters, and advocates have travelled all the way to The Hague to be present during the hearings. We remain committed to seeking truth and justice for victims and for all people.
